These Legal Terms constitute a legally binding agreement made between you and MyVase LLC ("we," "us," or "our"), concerning your access to and use of our mobile applications, App Clips, website at myvase.app, and any other products or services we offer now or in the future (collectively, the "Services"). YOU AGREE THAT BY ACCESSING THE SERVICES, YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY ALL OF THESE LEGAL TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. MyVase is an emotional performance utility, not a medical device. Our apps are productivity tools designed to provide guided sensory sessions to help professionals mentally transition and decompress.

We may offer paid access via auto-renewing subscriptions and/or one-time payments. Payments are processed by the platform through which you downloaded the app (e.g., Apple Inc. via the App Store, or Google LLC via Google Play).
Our website at myvase.app provides information about our products and may include a waitlist signup. By submitting your email to our waitlist, you consent to receiving product updates from us. You may unsubscribe at any time by emailing cecilia@myvase.app.
The Services and their original content, including the "MyVase" name and branding, all UI designs, graphics, animations, haptic patterns, audio content, interaction designs, software, and written prompts ("Our Content"), are the exclusive property of MyVase LLC and are protected by copyright and other intellectual property laws. Our Content is provided for your personal, non-commercial use only.

Our apps currently operate on a local-first privacy architecture. Unless otherwise specified for a particular feature, the Services do not require you to post, send, or upload personal content to our servers. All data related to your sessions ("Session Data"), including any audio recordings you may create within the app, is stored on your local device by default. Session Data stored locally is not considered "User Generated Contributions" under this agreement as it is not transmitted to or accessible by us. If we introduce features that involve server-side storage of user content in the future, we will update these Terms and clearly disclose the change.
You grant us no license to your private, local-only Session Data. We have no technical ability to access, view, or use this data.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYVASE LLC OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100.00) OR THE TOTAL AMOUNT YOU PAID US (THROUGH APPLE) IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Services; (2) your breach of these Legal Terms; or (3) your violation of the rights of a third party.
We will maintain minimal authentication data that you transmit to the Services for the purpose of managing your account and subscription.
You are solely responsible for all local data stored on your device by our apps, including your session history, preferences, and any audio recordings. As this data is stored only on your device, you acknowledge that we have no ability to access, back up, or restore this data. YOU AGREE THAT WE SHALL HAVE NO LIABILITY TO YOU FOR ANY LOSS OR CORRUPTION OF ANY SUCH LOCAL DATA, AND YOU HEREBY WAIVE ANY RIGHT OF ACTION AGAINST US ARISING FROM ANY SUCH LOSS.
Using the Services, sending us emails, and completing your registration constitute electronic communications. You consent to receive electronic communications (such as administrative emails or in-app notices) and you agree that all agreements, notices, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.
These Legal Terms and any policies posted by us on the Services constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision shall not operate as a waiver of such right. If any provision of these Legal Terms is held to be unlawful or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions.
